General terms & conditions

TRE Commerce B.V.B.A. has its registered office at Torfbrug 1, 2000 Antwerp, and is registered under company number 0888.518.713, RPR Antwerp. The VAT number is BE 0888.518.713.

1. Subject to stipulations to the contrary in writing, the relationship between TRE Commerce B.V.B.A. and its clients are governed by the current general terms of sale deemed to be accepted by the client, also should they be contrary to the client's own general or special terms and conditions.

2. With respect to products from Château Blanc, the customer declares that they are intended for personal use (or as a gift, to be given away without charge) and will NOT be traded. Customers who wish to trade in the products are requested to get in touch with Château Blanc directly.

3. The information concerning the products and the pricing, as well as the detailed order information that the customer can see on the order pages, are compiled and issued subject to the right of amendment and correction being reserved.

4. The goods are sent at both the cost and the risk of the customer to the delivery address given by the customer. Incorrect delivery addresses are the responsibility of the customer and may lead to additional costs. Possible delays in the delivery will under no circumstances lead to compensation being paid.

5. TRE Commerce B.V.B.A. is not responsible for any import or customs fees, or any other cost that a delivery outside the EU could bring.  

6. If it is impossible to deliver the product, the agreement is dissolved by operation of law. The seller is obliged to notify the customer in writing before the delivery period has ended. In the case of partial delivery, each delivery will be considered a separate sale.

7. Given the perishable nature of our products and the current hygiene requirements, the buyer explicitly waives the right to decide against buying the product. For this reason goods cannot be sent back.

8. With the capacity of the intermediary taken into account, TRE Commerce B.V.B.A. limits its guarantee for delivered goods to the guarantee awarded by the supplier. Insofar the terms and conditions and the scope of this guarantee allow, TRE Commerce B.V.B.A. will at any rate restrict its intermediation to the replacement of defective parts or the repayment of the price paid without the client being able to claim greater damages. TRE Commerce B.V.B.A. can never be held liable for the non-fulfillment by a supplier of the latter's obligations with respect to the execution of the guarantee in, amongst other things, a case of bankruptcy on the part of the supplier. TRE Commerce B.V.B.A. is not responsible for the losses or for material or other damages, of any nature whatsoever, incurred by the client or a third party as a result of the use of the goods. With respect to foodstuffs, of any nature whatsoever, TRE Commerce B.V.B.A. advises diabetics and people with allergies to read and follow the enclosed pamphlet.

9. Complaints or disputes should be made known within 7 days of delivery in writing and sent by registered post under penalty of cancellation. If the complaint is found to be grounded, our liability is limited to the replacement of the goods. Any liability on the part of the seller limits itself to the actual amount paid for the order.

10. TRE Commerce B.V.B.A. remains the owner of the sold products until complete payment of the price and possible penalty interest and/or damages are paid.

11. Should one of the current conditions be declared invalid or inapplicable, the remaining conditions remain in full force and this condition will be applicable to the degree tolerated by the law.

12. Within the framework of their relationships, all parties accept the electronic evidence (email, backups, etc.).

13. Disputes arising from the conclusion of, the validity or the execution of the contract or of these general terms and conditions are exclusively governed by Belgian law and fall exclusively within the jurisdiction of the Courts of Antwerp. These general conditions are also drawn up in Dutch. The Dutch text shall always override in case of dispute.
